Terms and Conditions

TERMS AND CONDITIONS

Please read these Terms and Conditions carefully. By using the Camp Australia Outside School Hours Care Service, Before and After School Care or Vacation Care (referred to as the “Service/s”) you agree to be bound by these Terms and Conditions.

If you do not understand, or do not accept, any or all of the terms or conditions, please contact Customer Care on 1300 105 343 or oshc@campaustralia.com.au. They are available 24 hours a day, seven days a week.

References in these Terms and Conditions to ‘Camp Australia’, ‘we’, ‘us’ or ‘them’ means Camp Australia Pty Ltd (ABN 96 060 703 120) and its related entities.

References to ‘I’, ‘my’ and ‘you’ are to the parent/s/guardian/s who completed the registration form for the Services.

The specific session fees for the Services are set out in the Service Information Flyer for the Service and also listed on the school page that can be viewed from www.campaustralia.com.au. You can also check all ancillary fees and charges that may apply to our Services at clause 15, 18 and 19.

GENERAL TERMS AND CONDITIONS OF ATTENDANCE AT ALL CAMP AUSTRALIA SERVICES

1. This section (General Terms and Conditions of Attendance at All Camp Australia Services) applies to all Services.

2. I confirm that I have requested Camp Australia to enroll the registered child (“the child”) for the Services as stated in the registration form.

3. I confirm that I am the parent / legal guardian of the child, and all information supplied is accurate and complete, and will be updated when needed.

4. I give permission for the child to participate in all enrolled program activities. I acknowledge that activities may include watching G rated videos/movies.

5. I authorise Camp Australia staff to obtain all necessary medical assistance and treatment for my child (including ambulance transportation) when needed and agree to pay the expenses for such medical assistance and treatment.

6. I confirm that I have supplied Camp Australia all the details for any existing health or medical condition and/or medication for the child, and I will update that information when required.

7. I authorise Camp Australia staff to take appropriate photographs/videos of the child engaging with the Service, which may be used for the limited purpose of producing marketing material for Camp Australia, the Services and for the School community. Photographs / videos may be used for (but not limited to) the Camp Australia education and care program materials, reflection journal, internal school communications and School newsletters. Photographs/videos may also be used for Camp Australia website content and for external service marketing purposes. I understand that photographs/videos will not be used for biometric matching or identification. Camp Australia will not identify the child’s name (or other details) in its use of any photographs/videos at any time. I will notify Camp Australia if I do not authorise them to take suitable photographs/videos of the child.

8. I acknowledge that the child will not attend the Service if suffering from an infectious or communicable disease as identified by the Department of Health. If required, by Camp Australia I will provide a health certificate confirming that the child is not suffering from an infections or communicable disease.

9. I agree to sign the child in/out on the appropriate documentation on arrival/departure each day the child attends. I understand that a late pick up charge of $15.00 (incl GST) per 15 minutes or part thereof, per child, applies when the child is collected after the Service’s advertised finishing time.

10. I acknowledge that I must notify Camp Australia if the child will be absent for any booked day for Services. I acknowledge that cancellations must be made within the time frames outlined in my Account level (Blue, Silver or Gold). I understand that full fees may apply for late cancellations and no-shows.

11. I acknowledge and agree that subject to law, Camp Australia does not accept any liability for personal injury, property damage or loss sustained by any child as a result of his or her participation at the Service (except in the case where such liability is a direct consequence of a negligent act or omission of Camp Australia and its staff).

12. I authorise Camp Australia staff to apply sunscreen to my child, and to give medications to my child as outlined in any written directions that I provide.

13. I understand that Camp Australia has policies for standards of behaviour. If the child does not meet those standards or otherwise demonstrates inappropriate behaviour, Camp Australia has the right to suspend the child’s enrolment for a specified period, or exclude the child permanently from the Service. Camp Australia will notify me of any behaviour that does not comply, and where appropriate provide warnings before any suspension or exclusion form the Services. I acknowledge that if the child is subject to exclusion from the Service, Camp Australia may disclose the child’s name and reasons for the exclusion to persons in control of the School at which the Service is operated.

14. I understand that Camp Australia will calculate Service charges in 2 week blocks. Camp Australia will provide statements which set out the fees charged for each 2 week block. Camp Australia will issue a statement for Services after the end of each 2 week block, with payment to be made the following week. (The payment due date will be stated in the statement).

15. I acknowledge that Camp Australia invoices must be paid by the payment due date via Direct Debit from a Bank Account or Credit Card. I understand that an Overdue Account Fee of $20.00(incl GST) will be applied for each billing period my account remains unpaid. I understand that if my Direct Debit fails or is rejected, I will be charged a Failed Transaction Fee of $25.00 (incl GST). I understand that these fees and charges are applied to cover Camp Australia’s administration costs.

16. I acknowledge that all information that I have provided to Centrelink for child care assistance is accurate and complete, and is the same as information that I have provided to Camp Australia. I acknowledge that it is my responsibility to check my eligibility for any child care assistance, and communicate with Centrelink. I acknowledge that child care assistance may not always be provided.

17. I acknowledge that if any information provided to Centrelink is incomplete or inaccurate in any way, then the childcare assistance may not be applied to my statement, and the full amount of the fees must be paid until the required information is provided to Centrelink.

18. I understand that Camp Australia will charge an Enrolment Fee of $25.00 (incl GST) per annum pro rata upon second usage. This means if I my second usage is in Term 1 or Term 2 the Enrolment Fee will be $25.00 (incl GST), if my second usage is in Term 3 the Enrolment Fee will be $15.00 (incl GST) and if my second usage is in Term 4 the enrolment fee will be $10.00 (incl GST). My enrolment will expire on 31 December each calendar year and the Enrolment Fee will again become due and payable upon second usage in the new calendar year.

19. I understand that if I request my statements to be mailed to me, a charge of $2.00(incl GST) (for printing and postal charges) per statement will apply.

20. I acknowledge that Camp Australia may require fees payable in accordance with these Terms and Conditions be paid to CAIP Pty Limited.

21. I understand that upon registration, I will be defaulted to a Silver account and can change this by contacting Customer Care on 1300 105 343 if I want to downgrade or upgrade. I understand that my account level will determine the booking options (flexible bookings and cancellation periods) that apply and the different levels of session fees I can access under the Permanent Rate when creating a schedule. Bookings made outside the terms of the applicable account level for Permanent schedules will be charged at (higher) Casual booking rate for single bookings.

22. Blue account holders will be able to access Low-flex Permanent Schedule bookings and Casual bookings only.

23. Silver account holders will be able to access Standard-flex Permanent Schedule bookings and Casual bookings only.

24. Gold account holders will be able to access High-flex Permanent Schedule bookings and Casual bookings only. Gold accounts may from time to time also receive discounts and loyalty benefits for selecting this account level.

25. I understand that the specific session fees for the Services are set out in the Service Information Flyer for the Service and also displayed on the website for each school that can be found atwww.campaustralia.com.au.

26. Account levels can be downgraded (from Gold, to Silver to Blue) during the account year. If a parent chooses to downgrade their accounts the change will apply to all remaining bookings in their account for the remainder of the year.

27. Account levels can be upgraded (from Blue, to Silver to Gold) during the account year. All bookings will be changed to the session fee applicable to the new account level immediately following the date of change to the account level.

28. A ‘no-show’ is when the child is absent from the Service they were booked in to attend with no notice. Booking cancellation fees apply for no-shows in line with the cancellation requirements for your Account level and the booking type (see clause 41, 49, 56, 64 and 69)

29. A ‘walk in’ is when the child arrives at a Service which has not been booked. Casual fee rates apply for all walk-ins.

30. I agree that a booking will be made once I make it myself on the Parent Portal or by the Customer Care Team upon my request.

31. I agree that an existing booking will be successfully cancelled only when I cancel it on the Parent Portal or when the Customer Care Team member cancels it upon my request.

32. I agree to pay all charges for all bookings made for the child (unless cancelled within the required time for the Account level or booking type - see clauses 53, 59, 66 and 70). Charges apply regardless of whether the child actually attends the session.

33. I understand that if my account is not paid in full by the due date for payment, Camp Australia may suspend the child’s enrolment in the Service until payment is made. Seven days prior notice of any proposed suspension of the Services will be provided.

34. Camp Australia reserves the right to vary these Terms and Conditions (including all fees and charges) and will notify all account holders of any variations. Variations will be effective from the date notified (unless otherwise specified). You may cancel your account without penalty if you do not accept any material amendment to the Terms and Conditions (including any changes to fees and charges). Cancellation will be effective from the date that you notify us.

35. I acknowledge that in order for Camp Australia to provide the Services, it is necessary for me to provide personal information, including personal information for the child. Camp Australia takes privacy seriously. We will at all times collect, store, use and disclose your personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and our Privacy Policy. TERMS AND CONDITIONS SPECIFIC TO VACATION CARE

36. All terms and conditions set out in the “General Terms and Conditions of Attendance at All Camp Australia Services” apply in addition to the specific terms and conditions set out in this section (Terms and Conditions Specific to Vacation Care).

37. I understand that there needs to be a minimum number of children to run each Holiday Club. In the event a Service is cancelled, Camp Australia will notify me by phone and/or email a minimum of 2 days prior. A full refund of any fees paid for the cancelled Service will be made unless I accept an alternate location to attend the care session at another school. I understand that Camp Australia will not be liable to make any other additional payment to me in this event.

38. I understand that Services are subject to cancellation or alteration on short-notice in the event of unsuitable weather conditions or other factors which may arise that are beyond Camp Australia’s control. In the event a Service is cancelled, Camp Australia will notify me by phone and/or email as soon as possible should this become known. A full refund of any fees paid for the cancelled Services will be made. I understand that Camp Australia will not be liable to make any other additional payment to me in this event.

39. I give permission for the child to leave the school premises to participate in external activities as indicated in the Service program.

40. All bookings should be made at least 7 days’ in advance of the day of the Service. If a booking is made with less than 7 days notice, the full fee will be charged plus a late booking fee of $10.00 (incl GST) per booking to cover additional administration related to the last minute movement of children and the on costs involved in managing the impact on all 3rd party suppliers.

41. Bookings may be cancelled at any time by giving 7 days advance notice to Camp Australia. Bookings cancelled on less than 7 days’ notice, will be charged the full fee. The reason for this is that during Holiday Club programs Camp Australia is required to pay substantial deposits and grantees to our 3rd party suppliers and Camp Australia has invested in the resources and staffing to manage these sessions well in advance of 7 days.

42. Children with additional needs must be booked into a Service more than 2 weeks in advance to ensure funding and additional staffing needs can be met. Children with additional needs not booked within the relevant time period may not be able to use the nominated Service.



TERMS AND CONDITIONS SPECIFIC TO BLUE ACCOUNTS AND LOW-FLEX PERMENENT BOOKING SCHEDULES

43. All terms and conditions set out in the “General Terms and Conditions of Attendance at All Camp Australia Services” apply in addition to the specific terms and conditions set out in this section (Terms and Conditions Specific to Blue Accounts and Low-Flex Permanent Booking Schedules).

44. I understand that the session fee for Low-flex Permanent Booking Schedule bookings is stipulated in the Fees and times page of the school website for the Service that the child attends which can be found at www.campaustralia.com.au

45. The minimum number of bookings required to make a Low-flex Permanent Booking Schedule is the equivalent of 1 booking per week for the remainder of the school year. For example, if there are 38 weeks remaining in the school year at the time of creating a booking schedule, the minimum number of bookings will be 38 and can be made for any days/weeks as long as the number of bookings meets the minimum requirement. The minimum number of bookings must be made all at once and prior to the start of the first booking. The bookings can be made as recurring booked days, or for selected days.

46. The minimum number of bookings must be met for each child and each care type (Before School Care and After School Care) that is being used. If the child attends more than one School, the minimum number of bookings must be met per school as well.

47. In the event that the minimum booking requirement is not met when creating a booking schedule, then the casual fee rate (not Low-flex permanent booking rate) will apply to all bookings, as they will be recognised as casual bookings, not a booking schedule. Camp Australia will issue a statement for the increased fees applicable at the end of the calendar year.

48. Bookings as part of a Low-flex Permanent Booking Schedule must be made no less than 48 hours prior to the start of the session, otherwise they will be charged the Casual fee rate (which is an increased rate) as they will be regarded as a Casual booking, not a Low-flex booking. Casual fees are stipulated in the Parent Information Pack for the Service the child attends which can be downloaded from www.campaustralia.com.au

49. A low-flex booking cannot be cancelled without charge. Therefore if a low-flex booking is cancelled, it will be cancelled with charge and the full fees will remain due and payable.



TERMS AND CONDITIONS SPECIFIC TO SILVER ACCOUNTS AND STANDARD-FLEX PERMANENT BOOKING SCHEDULES

50. All terms and conditions set out in the “General Terms and Conditions of Attendance at All Camp Australia Services” apply in addition to the specific terms and conditions set out in this section (Terms and Conditions Specific to Silver Accounts and Standard-Flex Permanent Booking Schedules).

51. I understand that the session fee for Standard-flex Permanent Booking Schedules is stipulated in the Fees and times page of the school website for the Service that the child attends which can be found at www.campaustralia.com.au.

52. The minimum number of bookings required to make a Standard-flex Booking Schedule is the equivalent of 1 booking per week for the remainder of the school year. For example, if there are 38 weeks remaining in the school year at the time of creating a booking schedule, the minimum number of bookings will be 38 and can be made for any days/weeks as long as the number of bookings meets the minimum requirement. The minimum number of bookings must be made all at once and prior to the start of the first booking. The bookings can be made as recurring booked days, or for selected days.

53. The minimum number of bookings must be met for each child and each care type (Before School Care and After School Care) that is being used. If the child attends more than one School, the minimum number of bookings must be met per school as well.

54. In the event that the minimum booking requirement is not met when creating a booking schedule, then the casual fee rate (not Standard-flex permanent booking rate) will apply to all bookings, as they will be recognised as casual bookings, not a booking schedule. Camp Australia will issue a statement for the increased fees applicable at the end of the calendar year.

55. Bookings as part of a Standard-flex permanent booking schedule must be made no less than 48 hours prior to the session, otherwise they will be charged the casual rate (an increased fee) as they will be regarded as Casual bookings, not Standard-flex permanent bookings. Casual fees are stipulated in the Fees and times page of the school website for the Service that the child attends which can be found at www.campaustralia.com.au.

56. A standard-flex permanent booking can be cancelled at any time by giving 7 days prior notice. Bookings cancelled after that time will be charged the full fee. Where cancellations cause the bookings to fall below the minimum booking requirement (equivalent of 1 booking per week for the remainder of the school year), the cancelled booking will be charged the full fee.

57. If a booking is not cancelled within 7 days and/or the child does not attend the service the full session fee will be charged.



TERMS AND CONDITIONS SPECIFIC TO GOLD ACCOUNTS AND HIGH-FLEX PERMANENT BOOKING SCHEDULES

58. All terms and conditions set out in the “General Terms and Conditions of Attendance at All Camp Australia Services” apply in addition to the specific terms and conditions set out in this section (Terms and Conditions Specific to Gold Accounts and High-Flex Permanent Booking Schedules).

59. I understand that the session fee for High-flex Permanent Bookings Schedules is stipulated in the Fees and times page of the school website for the Service that the child attends which can be found at www.campaustralia.com.au.

60. The minimum number of bookings required to make a High-flex Permanent Booking Schedule is 20, however if there are less than 20 weeks remaining in the school year, it is the equivalent of 1 booking per week for the remainder of the school year. For example, if there are 13 weeks remaining in the school year at the time of creating a booking schedule, the minimum number of bookings will be 13 and can be made for any days/weeks as long as the number of bookings meets the minimum requirement. The minimum number of bookings must be made all at once and prior to the start of the first booking. The bookings can be made as recurring booked days, or for selected days.

61. The minimum number of bookings must be met for each child and each care type (Before School Care and After School Care) that is being used. If the child attends more than one School, the minimum number of bookings must be met per school as well.

62. In the event that the minimum booking requirement is not met when creating a booking schedule, then the casual fee rate (not High-flex permanent booking rate) will apply to all bookings, as they will be recognised as casual bookings, not a booking schedule. Camp Australia will issue a statement for the increased fees applicable at the end of the calendar year.

63. Bookings as part of a High-flex permanent booking schedule must be made no less than 2 hours prior to the session, otherwise they will be charged at the casual rate (an increased fee) as they will be regarded as Casual bookings, not High-flex permanent bookings. Casual fees are stipulated in the Fees and times page of the school website for the Service that the child attends which can be found at www.campaustralia.com.au.

64. A High-flex permanent booking can be cancelled at any time by giving 2 hours prior notice. Bookings cancelled after that time will be charged the full fee. Where cancellations cause the bookings to fall below the minimum booking requirement (20 bookings or equivalent of 1 booking per week for the remainder of the school year when there is less than 20 weeks remaining), the cancelled booking will be charged the full fee.

65. If a booking is not cancelled with 2 hours’ notice/or and the child does not attend the service, the full session fee will be charged.



TERMS AND CONDITIONS SPECIFIC TO CASUAL BOOKINGS

66. All terms and conditions set out in the “General Terms and Conditions of Attendance at All Camp Australia Services” apply in addition to the specific terms and conditions set out in this section (Terms and Conditions Specific to Casual Bookings).

67. I understand that the session fee for Casual bookings is stipulated in the Fees and times page of the school website for the Service that the child attends which can be found at www.campaustralia.com.au.

68. Any booking that does not meet the minimum booking requirement for the Account type, will be classified as a Casual booking.

69. Casual bookings may be cancelled at any time by giving 7 days’ prior notice. If a booking is not cancelled with 7 days notice and/or the child does not attend the service, the full session fee will be charged.
